1. The Service
Bulwark Aegis is a software platform that helps U.S. government contractors discover opportunities, assess fit, and generate draft response materials (such as capability statements and Sources Sought / RFI responses), together with an automated compliance assessment and a suggested go/no-go review. The Service uses third-party artificial-intelligence models to generate drafts from data you provide and from public government sources.
2. AI-generated output — drafts only, human review required
You acknowledge and agree that:
- All content the Service generates is a draft and a decision-support aid, not finished work product, legal advice, or a guarantee of any outcome.
- Compliance scores, "Red Team Review" verdicts, go/no-go recommendations, fit scores, and similar outputs are automated estimates that may be incomplete or incorrect. They do not replace a qualified human review.
- You are solely responsible for reviewing, correcting, verifying, and approving any output before relying on it or submitting anything to any government agency or third party. You are the offeror of record for any submission and bear full responsibility for its accuracy and compliance.
- The Service does not guarantee award of any contract, any particular CPARS or performance rating, any cost or margin recovery, or any compliance determination. Nothing in the Service is a substitute for advice from qualified legal, contracts, accounting, or security professionals.
3. Your responsibilities and acceptable use
You agree to: provide accurate account and company information; use the Service only for lawful purposes and in compliance with applicable law, including the FAR, DFARS, and export-control and data-handling rules; not upload data you are not authorized to share; and not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Controlled and sensitive information
Unless we have agreed otherwise in a separate written agreement, the Service is not authorized for storage or processing of Controlled Unclassified Information (CUI), classified information, ITAR/EAR-controlled technical data, or other information subject to specialized handling requirements. The Service is not represented as FedRAMP-authorized or CMMC-certified. Do not upload such information unless a signed agreement expressly permits it.
5. Customer data and ownership
As between the parties, you retain all rights to the data and documents you submit ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Service to you. We do not use your Customer Data to train shared or third-party AI models. You own the drafts the Service generates for you, subject to these Terms and any third-party rights in source materials. We retain all rights in the Service itself, including its software, models, templates, and aggregated, de-identified analytics.
6. Fees
If you subscribe to a paid plan, you agree to the fees and billing terms presented at purchase. Fees are non-refundable except as required by law or expressly stated. We may change fees on prospective notice.
7. Third-party services
The Service relies on third parties (for example, AI model providers, government data sources such as SAM.gov, hosting, and payment processing). Your use may be subject to their terms, and we are not responsible for their acts or omissions.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ACCURATE, COMPLETE, COMPLIANT, OR WILL RESULT IN ANY AWARD OR OUTCOME.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULWARK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, LOST OPPORTUNITIES, OR A LOST OR UNSUCCESSFUL BID, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE [TWELVE (12)] MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You will defend and indemnify Bulwark against claims arising from your Customer Data, your submissions to third parties or the government, or your breach of these Terms or of law, to the extent permitted by applicable law.
11. Term and termination
Either party may terminate as described in the applicable order or with reasonable notice. We may suspend or terminate access for breach or risk to the Service. On termination, your right to use the Service ends; you may request an export of your Customer Data for a limited period, after which we may delete it.
12. Changes to these Terms
We may update these Terms; material changes take effect on notice or on your next acceptance. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
